How Is Adultery Proven? Is It a Crime, and Which Evidence May Be Used?

Adultery is not a separate offence in the Turkish Penal Code; it is a specific divorce ground under TMK art. 161. An adultery allegation must be proved with lawfully obtained evidence. Direct imagery is not required; depending on the facts, witnesses, records and mutually supporting circumstances are assessed together. Suspicion, messaging or a single record is not enough on its own in every case.

Can Compensation Be Claimed from a Third Person Involved in Adultery?

Knowing that a person is married and having a relationship with that person does not, by itself, create liability in non-pecuniary damages toward the betrayed spouse. The 6 July 2018 decision of the Court of Cassation Grand General Assembly for the Unification of Case Law, E.2017/5, K.2018/7, adopts this distinction. If the third person also committed an independent act that directly attacks a personality right, the conditions for compensation may be assessed separately.

Article 166(4) of the Turkish Civil Code concerns a previous rejected divorce case, one year from finality of that rejection and failure to resume common life. The marriage does not end automatically when the year expires. One spouse must apply and the court must examine the conditions.

Law No. 6284 provides protective and preventive measures for people experiencing violence or facing a risk of violence. 2026 Alimony Increases: Judgment, Index and Calculation

There is no single increase rate applicable to every Turkish alimony case in 2026. First check whether the judgment contains an annual adjustment clause. If it does, the rate, period and starting date follow that clause. If it does not, inflation alone does not automatically increase the amount in enforcement proceedings.
